1.1 PROJECT INFORMATION
A. Notice to Bidders: Qualified bidders may submit bids for project as described in this Document. Submit
bids according to the Instructions to Bidders.

E. Project Description: The project to consist of a single story wood frame, wood roof joists, with standard
room finishes. The building to have classrooms, offices, entry, storage rooms, restrooms, and
includes complete plumbing and HVAC systems, electrical, site and landscaping. Building size is
10,143 square feet.
1. Project cost range is anticipated to be $2,700,000.00.
F. Minority, Women and Native American sub-contractors and support personnel and highly encouraged
to participate in this project.
G. Construction Contract: Bids will be received for the following Work:
1. General Contract (all trades).
H. NATIVE AMERICAN PREFERENCE
The owner intends to make available any and all opportunities for employment and training for Nisqually
Tribal Members, their immediate families, and all other Native Americans. Therefore, the Tribal Employment
Rights Ordinance (TERO) is in effect for this project. This may include but is not limited to:
Native American preference in employment. We have set a goal for each project to employ 35%
Native American preference in contracting.
3.00% TERO tax for every employer with a contract in the sum of $25,000.00 or more shall pay
this one-time fee on the total contract amount. The fee may be paid in installment over the term
of the contract.
TERO Employment Rights tax shall also extend to all Change Orders.
It is the responsibility of the Contractor to contact the TERO Office for additional details.

1.2 BID SUBMITTAL AND OPENING
A. Owner will receive sealed lump sum bids until the bid time and date at the location given below. Owner
will consider bids prepared in compliance with the Instructions to Bidders issued by Owner, and
delivered as follows:
1. Bid Date: December 28, 2018.
2. Bid Time: 2:00 PM, Local Time.
3. On the face of the Bid envelope note the following:

B. Bids will be thereafter publicly opened and read aloud.
1.3 BID SECURITY
A. Bid security shall be submitted with each bid in the amount of 5 percent of the bid amount. As an
option to a bid bond with a State Licensed Surety, certified check, or a cashier’s check is acceptable
and made payable to Nisqually Tribe of Indians. This surety shall be forfeited in event of failure by the
successful bidder to sign a contract or to furnish the necessary one hundred percent, (100%),
B. No bids may be withdrawn for a period of 60 days after opening of bids. Owner reserves the right to
reject any and all bids and to waive informalities and irregularities.

1.4 MINORITY REQUIREMENTS
A. The Bidder’s attention is called to the “NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO
INSURE EQUAL EMPLOYMENT OPPORTUNITY” (Executive Order #11246) contained in the bid
documents, which sets forth, in part, the goals and timetable for the employment of women and
minorities in the project area. Bid evaluation will include significant considering for involvement of
NATIVE AMERICAN contractors, engineers or sub-contractors, licensed to performed services in the
State of Washington. Contractor’s must apply every “good faith effort” to see that minorities and
women comprise a portion of each construction trade on this project and to the maximum extent
feasible, lower income persons are given employment opportunities and businesses in the community
are given contracting opportunities on this project.
A. Procurement and Contracting Documents: Contract Documents will not be issued by the Owner or
Architect. General Contractors and Sub-Contractors may contact plan centers for plans and
specifications at their own expense.

1.6 TIME OF COMPLETION AND LIQUIDATED DAMAGES
A. Successful bidder shall begin the Work on receipt of the Notice to Proceed and shall complete the
Work within the Contract Time.
B. Time of Substantial Completion is August 17, 2019.
C. Liquated Damages: Liquated damages will be assessed at a rate of $4,840.00 per calendar day the
project exceeds the Substantial Completion date.
1.7 BIDDER’S QUALIFICATIONS
A. Bidders must be properly licensed under the laws governing their respective trades and be able to
obtain insurance and bonds required for the Work. A Performance Bond, separate Labor and Material
Payment Bond, and Insurance in a form acceptable to Owner will be required of the successful Bidder.

1.9 PRE-BID MEETING
A. A NON-MANDITORY Pre-Bid Meeting will be held on Wednesday, December 5, 2018, at 2:00 PM, in
the Existing Daycare building, at located at 61 Rodeo Drive, White Swan, WA. General Contractors
and major Sub-Contractors are highly encouraged to attend.
A. The Advertisement for Bids, Plan Holder List, all Addenda, and Bid Tabulation will be posted at the
Yakama Nation Administration, (address above) at the conclusion of the bidding process.
