1.2 QUESTIONS REGARDING THE BID NOTICE: Requests for interpretation/clarification of the Bid Notice
document and all questions regarding the bid specifications and drawings must be made in writing
and submitted to Mr. Mark Morrison by email, fax (509)534-4943 or by mail 221 North
Wall Street, Suite 600, Spokane, WA 99201. Unauthorized contact with other tribal employees
regarding this Bid Notice may result in disqualification. All oral communications will be
considered unofficial and non-binding on the Colville Tribes. Questions will be addressed promptly.
No questions will be accepted after 4 p.m. Monday, February 17, 2020.


A. Contractor shall submit the bid at the bid time, date and location indicated below:
1. Bid Date: Monday, February 24, 2020.
2. Bid Time: 2:00 p.m., local time.
3. Location: Womer & Associates Office at 221 N Wall St, Suite 600, Spokane WA 99201. All Bids and
accompanying documentation will become the property of the Confederated Tribe of the Colville
Reservation and will not be returned. Contractors accept all risk of late delivery of mail
regardless of fault.
4. The Tribe will issue a Letter of Intent no later than March 2, 2020 to the selected bidder.


A. Bidders must be properly licensed under the laws governing their respective trades and be
able to obtain insurance and bonds required for the Work.


A. SOVEREIGN IMMUNITY: Nothing in the Contract for this work shall be construed as a waiver of
or diminishment of the Tribes inherent sovereign immunity.

B. TAXES: Project shall comply with tax exemptions for Indians and Indian Tribes, according to
current Washington Administrative Code WAC 458-20-192.

C. As this project is funded by the State of Washington; General Decision: WA160079 01/08/2016
WA79 will apply. Contractor will be required to submit certified payrolls.



A. AIA Document A701, “Instructions to Bidders,” is hereby incorporated into the
Procurement and Contracting Requirements by reference.

1.2 REJECTION OF PROPOSALS: The Colville Tribes reserves the right to reject any or all proposals,
to waive any minor informalities or irregularities contained in any proposal, and to accept any
proposal deemed to be in the best interest of the Colville Tribes.

1.3 PROPOSAL VALIDITY PERIOD: Submission of a proposal will signify the Contractor’s agreement that
its proposal and the content there of are valid for 60 days following the proposal response
deadline unless otherwise agreed to in writing by both parties. The proposal response will become
part of the Contract negotiated between the Colville Tribes and the successful Contractor.

1.4 EQUAL OPPORTUNITY REQUIREMENTS: The Colville Tribe is an equal opportunity employer and

contractor, in the performance of the Contract, agrees not to discriminate in its employment
because of the employees or applicant’s race, religion, national origin, ancestry, sex, age, or
physical handicap.

1.5 OTHER COMPLIANCE REQUIREMENTS: In addition to the nondiscrimination and affirmative action
compliance requirements previously listed, the Contractor awarded a contract shall comply with
Tribal, Federal, State and local laws, statutes and ordinances relatively to the execution of the
work. This requirement includes, but is not limited to, protection of public and employee safety
and health; environmental protection; waste reduction and recycling; the protection of natural
resources; permits; fees; taxes; and similar subject.

1.6 CONFIDENTIALITY OF INFORMATION: All information and data furnished to the Contractor by the
Colville Tribes and all other documents to which the Contractor’s employees have access during the
term of the Contract, shall be treated as confidential to the Colville Tribes. Any oral or written
disclosure to unauthorized individuals is prohibited.

1.7 SAFETY: All applicable regulations pertaining to the safety, the Contractor shall strictly
adhere to; including Tribal Occupational Safety and Health Act (TOSHA) standards and regulations
and OSHA 29CFR 1910.1001 & 1926.1101. Particular care shall be exercised in connection with the
operation of vehicles and other equipment on the site.

of your company; or the most recently audited financial statement for your company.


A. Notice is hereby given that the Confederated Tribes of the Colville Reservation has in force the
Tribal Employment Rights Ordinance (TERO), Indian Preference in Contracting, covering but not
limited to Indian employment

1.10 TERO

A. The Colville Tribal Employment Rights Ordinance (TERO), including the 5% TERO fee shall apply to
the Contract to the extent any of the work to be performed under the Contract is on or near the
Colville Indian Reservation. No work will take place until a TERO Utilization Plan has been signed,
approved and filed with the TERO office. The 5% TERO fee applies to all contracts over $5,000.00
where the contractor is not a preference-certified entity.

B. The TERO Fee applies only to the General Contractor. All Sub-Contractors are not required to pay
a TERO Fee.
