1.1 PROJECT INFORMATION

A. Project Description: Project consists of site clearing, earth moving, exterior improvements

including asphalt paving, concrete curbing, concrete walks, drainage swales, pavement striping,

and street lighting.

B. Construction Contract: Bids will be received for the following Work:

C. This is a Federal Department of Labor, State of Washington Prevailing Wage Rate project.

Prevailing Wage Rates are in accordance with County of Stevens prevailing wage rates

including all required benefits. https://beta.sam.gov/wage-determination

D. NATIVE AMERICAN PREFERENCE

The owner intends to make available any and all opportunities for employment and training for

Spokane Tribal Members, their immediate families, and all other Native Americans. Therefore,

the Tribal Employment Rights Ordinance (TERO) is in effect for this project. A TERO Compliance plan will be required. Other requirements include but is not limited to:

• Native American preference in employment.

• Native American preference in contracting.

• 5% TERO Administration Fee on projects.

• TERO Administration Fee shall also extend to all Change Orders.

• TERO Fee will be paid at each monthly construction payment draw.

E. PRE-BID CONFERENCE

A Pre-Bid Conference will be held on Friday, March 22th 2024, at 1:00PM local time, 2555

Smith Road, Chewelah, WA 99109. This is a non-mandatory meeting, but all General

Contractors and major Sub-Contractors are highly encouraged to attend. Last day for

questions is Friday, March 29th 2024, at 3 PM local time.

1.2 BID SUBMITTAL AND OPENING

A. Owner will receive sealed bids until the bid time and date at the location given below. Owner will consider bids prepared in compliance with the Instructions to Bidders issued by Owner, and delivered as follows:

1. Bid Date: April 4, 2024

2. Bid Time: 3:00 PM, local time.

On the face of the Bid envelope note the following:

B. Bids will be thereafter publicly opened and read aloud.

1.3 BID SECURITY

A. Bid security shall be submitted with each bid in the amount of 5 percent of the bid amount. As an option to a bid bond with a State Licensed Surety, certified check, or a cashier’s check is acceptable and made payable to Spokane Tribe of Indians. This surety shall be forfeited in event of failure by the successful bidder to sign a contract or to furnish the necessary one hundred percent, (100%), Performance Bond.

B. No bids may be withdrawn for a period of 60 days after opening of bids. Owner reserves the right to reject any and all bids and to waive informalities and irregularities.

TIME OF COMPLETION AND LIQUIDATED DAMAGES

A. Successful bidder shall begin the Work on receipt of the Notice to Proceed and shall complete the Work within the Contract Time.

B. A Notice to Proceed is expected to be issued in Late April, 2024

C. Substantial Completion is August 31, 2024.

D. Liquated Damages: Liquated damages will be assessed at a rate of $250.00 per calendar day the project exceeds the Substantial Completion date.

1.5 BIDDER'S QUALIFICATIONS

A. Bidders must be properly licensed under the laws governing their respective trades and be able to obtain insurance and bonds required for the Work. A Performance Bond, separate Labor and Material Payment Bond, and Insurance in a form acceptable to Owner will be required of the successful Bidder.

B. Spokane Tribe of Indians encourages the participation of Minority Owned and Women Owned Business Enterprises in this Invitation to Bid, however Native American will take preference.

The Owner will not answer any questions.

1.7 GENERAL CONTRACTOR PLAN NOTICE

A. General Contractors bidding this project are to notify the Engineer’s office that they are a plan holder to allow for future communication during the bidding stage of the project. Engineer contact is noted above in paragraph 1.7.
